Family Law

Mannion solicitors have provided Family Law advice for some 35 years during which there have been enormous changes in this area of law.

Judicial Separation in 1989, Divorce in 1996, Civil Partnership in 2010 have brought countless changes for individuals, children and families. Relationship breakdown is invariably stressful not just for the individuals concerned but for any children and the extended families. There are difficult decisions to be made at a time when many feel most vulnerable. If there are children, such decisions can be all the more painful if exacerbated by communication blocks between the parties.

We at Mannion Solicitors offer sensitive advice, encouraging mediation and availing of collaborative law where possible and pro active co-parenting so that a Court application for Judicial Separation or Divorce is the last option used, as often as possible when a working solution has been agreed and implemented.

We attend the Dublin and outlying Courts, covering all areas of Family and relationship breakdown.

We draft and advise on completion of Separation Agreements at reasonable cost, avoiding Court Proceedings whenever possible.

We advise non-marital, cohabiting persons and same sex couples when relationships or civil partnerships break down. Consideration of the “opt out” provisions of the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010 is advisable for parties entering into such co-habiting relationships.

A Will, completed and signed  in accordance with the law, requires skilful consideration. A vital document on death,  it should be reviewed and updated regularly .

Mannion Solicitors ensure clients young and old keep a properly prepared Will, meeting clients’ requirements whilst minimising Taxation implications. Spend the time and some small money now can save much more money later.

Administration of Estates

The death of a loved may be a sad but ought not be a traumatic experience. Mannion Solicitors have extensive experience of all aspects of Estate Administration, taking out Probate,  administering Estates when no Will has been made, completing Deeds of Family Arrangement where appropriate. Advising executors on their duties and obligations, to beneficiaries and next of kin, we ensure the process is dealt with efficiently and clearly explained. .

We have nearly 40 years practical experience in advising executors, beneficiaries and family members on all such issues, including Wills’ or Estate administration disputes. Conscious that such disputes can cause hardship and anger, we approach such disputes with great sensitivity whilst protecting our clients’ interests.
Mannion Solicitors can advise on taxation aspects affecting beneficiaries, utilising an extensive range of tax agents and independent advisers when appropriate.

Enduring Powers of Attorneys

Mannion Solicitors advise all clients to carefully consider how they might cope in the event that they or other family members suffered tragically from an accident or illness depriving them of their mental capacity and the ability to look after their own affairs.

We advise on the appropriate steps and actions necessary to put in place precautionary measures to deal with such possibilities. Why not  appoint a family member under an Enduring Power of Attorney to have legal responsibility for loved ones’ if such occurred ?

Wardship

Wardship arises where someone no longer has capacity or has diminished capacity to look after his/her affairs if no Enduring Power of Attorney had been done.
We advise on the steps to be taken, ensuring transparency in all we advise throughout a challenging process for those not used to such difficulties, often sudden or unforseen.

On a successful application to have a person entered into Wardship, a Committee is appointed to look after the Ward’s affairs, his/her wellbeing, needs and requirements, whilst acting under the guidance, instruction, and protection of the High Court.

We advise on Representative Care Orders in the Circuit Court under the Fair Deal and Nursing Home Support schemes.

Suffering personal injury in a car crash, workplace or other accident is always a difficult experience. When such injury is caused by others and gives rise to a claim for compensation, we  seek to resolve all claims as quickly as possible while at the same time ensuring the best possible outcome. While all would rather have avoided injury, we seek the best compensation possible, treating each client and claim sensitively by listening to our clients, ensuring we explore fully the impact of such injuries on each client’s life.

We routinely bring applications to the Personal Injuries’ Board and when either liability is in dispute or the Board’s assessment is deemed inadequate or unsatisfactory, we take such cases on to the Courts. We offer professional and efficient advice during the course of the Legal Proceedings ensuring, at all times, that the client is at ease with the process, fully informed of the necessary steps taken. Above all, we add value.

We have acted in many “hit and run” cases and in cases in which the party responsible is either uninsured or unidentified, instituting claims against the Motor Insurers Bureau of Ireland, set up to meet such claims.

We have been involved in many fatal injuries’ cases, often appearing at Inquests in the Coroner’ Courts. Making a claim for compensation will obviously not be the first thing loved ones will think of, but in some cases compensation for wrongful death will be essential for the family to carry on. Mannion Solicitors approach all such cases with sensitivity and empathy towards the surviving family members whilst bringing our experience to bear in such technical and complex cases.

We have brought paraplegia and acquired brain injury claims requiring specialist knowledge of such life-changing catasprophic accidents. We have brought medical negligence cases, again availing of extensive experience of international expert witness evidence.

We act in civil litigation cases in the Circuit or High Courts, achieving satisfactory outcomes for clients in the shortest possible time and at reasonable cost.

Where possible we encourage clients to engage in mediation or alternatively dispute resolution and thereby avoid the costs of going to Court. We do not see mediation, conciliation or alternative dispute resolution as divisive but rather as a very useful mechanism so that litigation remains the final weapon of choice.
